Terms & Conditions

1. Overview

These Terms & Conditions apply to all website development services (“Services”) delivered by 44-Media Ltd (“we”, “us”, “our”). By proceeding with the project, the client (“you”, “your”) agrees to these terms.

2. Scope of Service

Unless otherwise stated, your website package includes:

• Full website design and development
• All page content as provided or approved by you
• SEO foundations including Google My Business optimisation
• One (1) revision cycle prior to going live
• First draft delivery within 72 hours from receipt of required materials. Full delivery within 14 days of receipt.

If you have selected any management service, your service additionally includes:

• Minimum 2 hours of monthly edits or updates
• Ongoing payment of your Content Management System (CMS), security, maintenance and support as part of your package

If you have not selected Management, your service includes:

• Website build and all included content
• Transfer of ownership upon completion
• No ongoing edits or management

3. What Is Not Automatically Included

The following items fall outside the standard service unless explicitly agreed in writing:

• Paid advertising or PPC campaign management
• Unlimited revisions
• Complex third-party integrations
• Ongoing maintenance (unless part of Management)

4. Client Responsibilities

To allow us to meet the 14-day delivery timeline, you agree to:

• Provide required content, branding assets, and instructions promptly
• Attend the revision meeting (where applicable)
• Provide revision notes within agreed timeframes

Failure to respond within reasonable timeframes may delay delivery.

5. Payment Terms

Payment is due after the website is built, typically following the revision meeting and your confirmation that the website meets the agreed requirements.

If you cancel the project before completion, you:

• Forfeit any deposit paid
• Will not be charged the remaining balance

6. 30-Day Money-Back Guarantee

Your Client Acquisition Plan is protected by a 30-day money-back guarantee. If you’re not satisfied with the service within your first 30 days, you may request a refund of your first monthly payment, provided you’ve completed the required onboarding, supplied the information/access reasonably required for us to deliver the service, and allowed us a reasonable opportunity to implement the agreed services. The guarantee applies to your first monthly payment only and excludes third-party costs, advertising spend and additional services purchased separately. Full terms apply.

Refund eligibility requires that:

• The website was completed as agreed
• You provided all required content in a timely manner
• You did not remove, disable, or materially alter the website in a way that affects performance

Refunds do not apply to:

• Paid advertising costs
• Monthly management fees
• Additional services

7. Ownership & Intellectual Property

Upon full payment:

• You own 100% of the website and its contents
• Source files, copy, design, and assets are transferred to you
• We retain no ownership once payment is complete

The Client retains ownership of its customer data, contacts and business-specific content.

Any workflows, automation frameworks, templates, processes, software configurations and proprietary systems supplied or developed by 44-Media remain the intellectual property of 44-Media unless otherwise agreed in writing.

Access to these systems is provided for the duration of the Client’s active service with 44-Media and does not constitute a transfer or sale of the underlying systems or intellectual property.

If payment is not received, ownership remains with 44-Media Ltd until resolved.

8. Website Ownership & Transfer

Where a website is designed, developed and/or provided by 44-Media as part of an ongoing monthly service without a separate website development fee, the website and its underlying design, build, templates and configuration remain the property of 44-Media for the duration of the service.

The standalone value of the website is £995.

The Client may cancel their ongoing service in accordance with these Terms without being required to purchase the website. Upon termination, 44-Media’s obligation to host, maintain and provide access to the website will end.

If the Client wishes to retain and take ownership of the website following termination, they may purchase the website for £995. Once payment has been received in full, 44-Media will provide or facilitate transfer of the Client’s website to the Client or their nominated provider, subject to reasonable technical limitations and excluding any 44-Media proprietary systems, software, licences, automation frameworks or third-party services.

Any website development fees previously expressly paid by the Client towards ownership of the website will be dealt with in accordance with the Client’s individual order or agreement.

9. Support & Communication

Our support hours are:

• Monday – Friday, 8:00am – 5:00pm (UK Time)

We aim to reply to all messages within 2 hours during support hours.

10. Data Protection & GDPR

44-Media Ltd is an ICO registered company and complies with GDPR and UK Data Protection legislation.

We will:

• Only use your data for project delivery and communication
• Never sell, transfer, or share your data with third parties other than essential service providers
• Store data securely and only for as long as necessary

You are responsible for ensuring any data provided (e.g., customer lists, images, copy) has been collected lawfully.

11. Limitation of Liability

We are not liable for:

• Loss of revenue due to delays caused by missing client content
• Third-party platform outages (e.g., hosting provider, Google services)
• Losses arising from changes you make after handover

12. Acceptance of Terms

By proceeding with the project, completing payment, or submitting onboarding information, the client confirms they have read and agree to these Terms & Conditions.

13. Modifications

44-Media reserves the right to modify these terms and conditions at any time. We will notify you of any changes via email or through our website. Continued use of our services after modifications indicates your acceptance of the updated terms.
